TERMS OF ENROLMENT

(“Agreement”)

Smart Body and Performance LTD strives to provide the greatest possible experience for all our clients and the following agreement outlines some parameters and terms of the programme.

To fully experience and gain the most from the coaching, you agree to the following:

SECTION 1. PROGRAMME GUIDELINES, PAYMENT TERMS

You hereby authorise Smart Body and Performance LTD to collect the programme cost discussed on our call through either:

A) “Agreed upon” up-front payment for commencement of services

B) Successive monthly payments with the first payment being due on the date of enrolment in the programme and all subsequent payments being due 30 days after the previous payment. Payments are due in full on the due date.

If payments fail, clients must remedy this situation as soon as possible. Please contact a member of the team as soon as possible. For all credit and debit card payments:

You hereby consent to having these charges automatically charged to your credit or debit card on the due date. Smart Body and Performance LTD Is authorised to collect payment due (in full) by collecting on any/ all credit or debit cards that are provided by the Smart Body and Performance Ltd client.

The client may determine which payment method is preferred and the client is responsible for informing Smart Body and Performance Ltd.

Coaching Duration, Better Than Money-Back Guarantee:

Upon enrolling into the program, you will receive an initial 12 months of coaching in addition to the instruction found inside the programme, thereafter the services will resume on a monthly basis for however long you see value.

Additionally, Smart Body and Performance LTD provides a better-than-money-back guarantee, meaning that Reece and his team will coach you for as long as it takes to get you the agreed-upon results if not seen within your initial 12-month commitment period. Reece and his team embody a “whatever it takes” mentality to get you results, as you are our top priority.

This means that if you have not seen results and physique changes by the end of the 12 months of coaching AND you show that you have taken full action, Reece and his team will continue to coach you for however long you need until you do so.

This is dependent on the fact that you have taken full action on everything learned inside the program, including:

• 90% compliance with training and nutrition

• A completed check-in each week

• Reaching out to your coach and asking questions if you’re struggling or have any issues

If you did not see results on the program, and upon review it is discovered that you did not fully implement the above criteria, then the Better Than Money Back Guarantee is therefore voided. We only offer guarantees to people who follow through on their word and take action. (Success with this programme is largely driven by your willingness to take actions recommended by Smart Body and Performance Ltd, this relates to the content of the programme)

Promotional Material:

By accepting the terms of this Agreement and affirmatively seeking the benefits of Coaching Services offered by Smart Body and Performance LTD, you affirmatively agree and acknowledge that Smart Body and Performance LTD may showcase any testimonial(s) describing or otherwise referencing, either directly or indirectly, your experience participating in such coaching service(s), including any specific results experienced by you over the course of such participation.

SECTION 2. PARTICIPATION TERMS

Either party may terminate these terms, if there has been a material breach of these terms subject to following the dispute resolution procedure.

2a. Participation

We are committed to providing all programme participants with a life-changing experience, thus, Smart Body and Performance LTD may cancel your participation on any of its programmes, if believed you are not a good fit for us.

I understand that physical exercise can be strenuous and subject to risk of serious injury, you are urged to obtain a physical examination from a doctor before participating in any exercise activity. You agree that if you engage in any physical exercise/activity or make any changes to your diet are done so entirely at your own risk.

2c. Cancellation Terms

Online coaching is an initial 12-month minimum commitment which will become a rolling monthly contract thereafter. Smart Body and Performance Ltd requires 30 days’ notice for cancellation after the initial 12-month commitment.

Once your coaching has discontinued there will be a rolling £9.99/pm to retain access to the members area, if you wish for this to be cancelled, please state in your cancellation email.

Disrespectful or aggressive language at any time during the coaching can cause the coaching to be terminated without a refund.

Once plans are written, no refund will be given unless granted by your coach. Exceptional circumstances will be assessed on a case-by-case basis.

By consenting to these conditions you are agreeing that to achieve results requires you to complete all plans to 80% minimum adherence and check-in required on set day, failure to comply can affect your results and could lead to your coaching being terminated.

SECTION 3. PROGRAMME CONTENT

All materials, procedures, policies, standards, manuals, eating aids and other similar tools that have been or will be made available by Smart Body and Performance LTD or its designated facilitators, or any other source, oral or written are for individual use or in conjunction with this programme.

You can NOT sell, give away, or pass on the Private Label Rights, resell, or master resell rights to the content. You can NOT sell, give away, or pass on the editable files to anyone. You can NOT add the content to White Label, PLR, Resell Rights, or Master Resell Rights membership sites or stores.

You can NOT add the content to free internet marketing membership sites, forums, or social media pages/groups. You can NOT add the content to article directories.

The information contained in the programme material is strictly for educational purposes. Success with this programme is largely driven by your willingness to take actions recommended by Smart Body and Performance LTD.

You agree that you are responsible for contacting your coach if you have any issues, if you decide not to engage, your coach will assume everything is fine.

You agree that as a client you are a representative of the Smart Body and Performance brand and therefore must not engage in slander or defamation towards any other members of the fitness industry. You acknowledge that engaging in such behaviour can lead to the termination of your coaching immediately without a refund.

You agree that each member of the Smart Body and Performance community is to be treated with respect and there is a zero-tolerance policy towards racism, sexism or homophobia.

SECTION 4. TERMS OF SALE

You hereby agree that the programme sales are non-refundable (unless deemed within the money-back guarantee)

• You agree to make all payments on time and in full (outlined in section 1)

• You agree that you have fully consented to any payment to Smart Body and Performance LTD and that any/all payments are valid and that you have consented to the purchase of the programme as outlined in section 1.

• You agree to not initiate any disputes or claims through your credit card company, band, lending institution or any other payment provider since you have fully consented to all charges outlined in section 1 and thus you agree that you may not dispute any payments made to Smart Body and Performance LTD for the programme.
